Car Purchase and Sale Terms

Explains buyer and seller responsibilities, document verification, pricing, ownership transfer, delivery, and used-car condition.

1. Transaction role

The signed agreement for a specific car identifies the legal seller, legal buyer, vehicle, price, taxes and charges, and HonestDrive's role. Website branding alone does not determine who owns and sells the vehicle.

These general terms supplement, but do not replace, the signed vehicle sale/purchase agreement and statutory transfer forms.

2. Buyer responsibilities

  • Review the listing, inspection information, original documents, price breakdown, and agreement before payment.
  • Provide accurate identity, address, finance, and registration information.
  • Inspect and test drive the vehicle when reasonably possible.
  • Pay the agreed amount through approved channels and complete delivery/registration formalities on time.

3. Seller responsibilities

  • Have lawful, transferable title and disclose every owner, loan, hypothecation, challan, accident, insurance claim, modification, dispute, and material defect.
  • Provide genuine RC, insurance, PUC, service, invoice, NOC, identity, and finance-closure records where applicable.
  • Do not sell, pledge, materially alter, or create a new claim over the vehicle after accepting a transaction.
  • Cooperate with physical inspection, possession, payment, and ownership-transfer steps.

4. Price and charges

The listing price may not include every registration, transfer, insurance, finance, tax, warranty, service, delivery, or government charge. The final price summary and signed agreement control.

Any discount, add-on, booking-token adjustment, or dealer contribution should be documented in writing.

5. Ownership transfer and delivery

Delivery, risk, possession, and ownership transfer must occur according to the signed agreement and applicable motor-vehicle process. The parties must complete required transfer documents and cooperate with the relevant registering authority.

The delivery form should record odometer reading, keys, documents, accessories, visible condition, payment status, and date/time of handover.

6. Used-car condition

A used vehicle will have age- and use-related wear. No statement should be treated as a guarantee of new-vehicle condition. Express warranties apply only when written into the sale agreement or a separately accepted warranty plan.
